Ethernet or Token Ring checkpoint â⬠¢Saguaro Federal has mainframes for all of its banks and businesses. Must the company use the Ethernet or Token Ring protocol? Explain your choice. Why is this choice appropriate? In this particular situation I would have to say that the token ring protocol should be used for its banks and businesses and part of my reasoning is because it has banks and business that are not all located in the same building or so it seems.In Token Ring LANââ¬â¢s each station is connected to a wiring concentrator called a multistation access unit using UTP or STP. Some topologies for this are a ring or star with the ring topology being the more logical choice. The access method used on a Token Ring is called token which is a special data packet that is generated by the first computer that comes online in a token ring network, this token is passed from one station to another around the ring.A network device only communicates over the network when it has the tok en. â⬠¢XYZ Technology Consultants has offices on the second, third, and fourth floors of the office building it occupies. Must the company use the Ethernet or Token Ring protocol? Explain your choice. Why is this choice appropriate? In the XYZ technology consultants particular situation an Ethernet protocol. What first brought me to this conclusion was due of the company being located in one building on various floors.Ethernet is one of the most popular and widely used LAN technologies because of its speed, reliability, the cost, and lastly its ease of installation. Ethernet networks can be configured in either a star topology using UTP connected to a hub or a bus topology using a coaxial cable acting as a backbone. When a computer wants to send data over the network, it will listen to see if there is any traffic on the network, if it is clear, it will then broadcast the data through the network.

Gender segregation in children Essay
According to research children establish and maintain same gender relationships, the play in groups which are mainly composed of their own gender. Gender segregation has been observed in children as young as three years. Gender segregated social groups among children is significant within the segregated groups since children do experience different world from other peers and they have an opportunity to learn gender typed skills, roles, characteristics which are deemed by society. Gender segregation among children leads to different patterns of social interactions and play experiences promoting differences in their social, intellectual, and emotional development (Kimberley, 1995, p. 61). Children interaction is different depending on whether is a girl or a boy. Gender segregation is mostly influenced by expression of social interactions mainly during preschool activities. Cognition on play partners on children correlates with preferences of play partners. Social cognition accounts for changes in age in sex segregation (Martin, 1999, p. 751). Different interactive styles of children of different genders This examines individual variations in child pretense play and expression emerging mental representation. Children develop different interactive styles which are to some level at odds. Boys and girls react differently to situations with boys being more resistant and avoidance than girls (Martin, 1999, p. 755). There is a gender gap in the interactive styles among children. Child solitary play child are initiated y their mothers with maternal demonstration and solicitation. Mother symbolic and children language positively influence collaborative child play with verbal intelligence from child solitary play (Kimberley, 1995, p. 62). Different language/communication styles of children of different genders Communication language has been found to be harder in girls than in boys. Girls have significantly greater activation language areas in their brains compared to boys. Boys talk more and they are more assertive regarding their social interactions compared to girls (Kimberley, 1995, p. 62). Children stereotype believes about different gender roles Children learn mostly from parents with differences on how boys and girls behave being facilitated by differences on how they are treated by parents, teachers and friends (Martin, 1999, p. 760). Gender have differences on different issues like aggression, learning and they differently react to different situations (Kimberley, 1995, p. 64) Different preferences of different toys by different gender All over the world boys and girls play with different types of toys. Boys mostly prefer cars and trucks while girls prefer dolls. This is so because sociologically boys and girls are encouraged to play with different types of toys by their peers, parents or the society (Kimberley, 1995, p. 67). Theoretical (biological, social, cultural, etc. ) explanations for the gender differences Sex is believed to be natural but gender is cultural and a social construction. Differences among individuals in different gender are attributed to their choices but the differences are mainly as a result of gender conditioning. They undermine common humanity and individual freedom (Kimberley, 1995, p. 69). Children learn most things from their parents, teachers and peers. Socialization brings about sex role attitude. Parental influence changes children attitudes. Children behave based on their gender is also influenced by parents, teachers and media (Martin, 1999, p. 762). Human Brain: We can only estimate the processing power of the average human brain as there is no way to measure it quantitatively as of yet. If the theory of taking nerve volume to be proportional to processing power is true we then, may have a correct estimate of the human brainââ¬â¢s processing power. * by simple calculation, we can estimate the processing power of a average brain to be about 100 million MIPS (Million computer Instructions Per Second ). In case youââ¬â¢re wondering how much speed that is, let us give you an idea. * 1999ââ¬â¢s fastest PC processor chip on the market was a 700 MHz pentium that did 4200 MIPS. By simple calculation, we can see that we would need at least 24,000 of these processors in a system to match up to the total speed of the brain !! Computers have brought a revolution in human life. To begin with, computers took over different human activities. Now even thinking and problem-solving are being done by computer The situation makes many of us believe that computers are likely to replace human beings in every walk of life. Computer cannot solve the new problems that it has never met The humanââ¬â¢s development process is always raising problems and solving them again and again, these attributes cannot be possessed by the computer. , though computer can act like human, it is still a computer; it doesnââ¬â¢t have feelings or free will. We have feelings, we will be happy or unhappy, we will be ashamed when we do something wrong. We have soul and we are alive. We have free will to decide what to do. Can computer have feelings? It canââ¬â¢t. It has no will, what it is doing is only executing the programs made by human. I donââ¬â¢t think a computer can ever be replaced with a human, because it doesnââ¬â¢t have the same physical needs that we have. But I want a computer to interface with me almost like a human. At least on the interface side to be polite like a human, to understand my human needs. I want it to serve me and understand me as a human. However, I expect a computer to be better than a human in many ways, such as keeping track of time. I expect a computer to know what five minutes is. I expect a computer to be reliable. I expect a computerââ¬â¢s memory to be perfect. I expect a computer to do all the things that computers do well. Record video information ââ¬â humans canââ¬â¢t do that ââ¬â record audio information, do text-to-speech, keep an accurate and perfect record of time and what happens in time. All the things that a computer is flawless at and can do well. I want the computer to help me. Help me augment my memory, so that when I go to the doctor and they say ââ¬Å"What did you have for breakfast?â⬠it could show me, ââ¬Å"This is what you had for breakfast, I took a picture of it.â⬠Because thatââ¬â¢s what a computer can do for you. But I want it to understand that thatââ¬â¢s what I need, thatââ¬â¢s what I want. In order for the computer to understand what I need and what I want, it has to understand my emotional reactions to things, so that it can learn what it is that I need and want. A simple touch of mother silences a crying baby. Can a computer perform these and many such other miracles? Nowadays, teaching is being done by computers. Computer-lovers claim that the can learn with the help of a computer. Computers also administer tests, declare results and award certificates. But imagine the difference between the two situations, i.e., sitting before a computer and sitting in a class room with dozens of students around us and in the presence of a teacher. The pains and pleasures of companionship, the repudiating as well as encouraging expressions on the teachers face, the direct interaction, eye contact, spontaneous smiles and abundant sharing and understanding set this living situation a world apart from the lonely, computer-controlled suffocating room.

Counseling Session Essay Counseling can facilitate the process of overcoming or working through personal issues from everyday hardship as well as potentially life threatening situations. This reflective paper will explore the three 50 minute counseling sessions that I attended with a professional counselor and therapist, named Cassy Johnson-Hodge. By attending these counseling session and reflecting on Ms. Johnson-Hodges counseling process I have begun to understand the specific skills a counselor may use in session to help clients. Counseling requires the counselors to reach sensitively into their clients world and help them become aware of their strengths and hidden beauty (Michael S. Nystul, p 49). . The invaluable skills of open-ended questioning, paraphrasing, and reflection the counselor used had previously seemed insignificant to me, when it reality it can determine the difference between a helpful or a non helpful session. I was unsure of what to expect, prior to our first session as I have never received any professional counseling. I was nervous and anxious on the way to the session as I was unsure of where to start or how in depth the session would be. I had planned what I was going to say during the session, but I was still not feeling confident about it. I analyzed in my head what personal issues I could discuss as a student trying to learn the counseling processes, of course this was all based on my assumptions of what the counselor would ask. My nervousness and anxiety were immediately put to rest when I walked in the room where Cassy Johnson-Hodge gave me a warm welcome. Our first session began with an introduction, and I quickly explained to her that Im a student, and Im not sure what Im supposed to be at this point. Ms. Johnson-Hodges response to me was so caring and understanding, that I immediately felt comfortable enough with her to start having, what I would consider, a normal conversation. I still felt a little nervous , but I knewà she was providing me a safe judgment free environment to talk. Ms. Johnson-Hodge kept the conversation going for the duration of the session by affirming how I felt about my personal life goals, I also felt like she really understood what I was talking about, which inadvertently encouraged me to keep talking. By the end of the first session I was really amazed at how much I had talked. I really started to feel the counselor-client relationship developing when she helped me map our sessions. The style and technique, the counselor used throughout our sessions provided an appropriate solution for me and satisfy the goal we both agree to work on. I felt like Ms. Johnson-Hodge listened to what I was saying and directed the conversation in a positive way by asking open-ended questions to facilitate our conversation, paraphrasing what I was saying, and allowing me to reflect on what I had said. There were also other times when the counselor would reflect through silence. During such a period, I had noticed Ms. Johnson-Hodge study me and the information that I had given to her. At the end of the session, the counselor allowed me to ask her about how I feel by summarizing what I said to her. I think Ms. Johnson-Hodge did really good job as a result of pulling together a number of elements that I had offered her and reflected back was helping me to explore more. Works Cited Nystul, M. S. The Different Forms and Theories of Governments Government is a group of people either elected or imposed who exercise rule on behalf of citizens. The government should maintain law and order, ensure equality and provide public goods (Goldman et al, 2008). In the social contract theory, before government existed, life was short, brutal and nasty. Insecurity was very rampant due to the fact that there was no system that enabled there to be order in the society so it was survival for the fittest mode of life. Hence man sought for a way to improve the situation which was by giving up some of his powers to a higher authority called the leviathan, to control his selfish nature. They drew up a contract and that was the beginning of government. Ever since, there have been many forms of governments but for the interest of this paper, only three will be discussed presidential, totalitarianism and democracy. Totalitarianism is a form of government where there is no control of state power in the country and hence the ruling class seeks to consolidate its power via whatever means possible. The state is usually under control by one person, a faction or a ruling party with an ideology that controls all the public and private aspects of the people. This is the case in China where the ruling party dictates the affairs of the country and has for years consolidated its power (Li,2008).The state also controls the flow of information in and out of the country. That means that there is state controlled media and the government filters internet content. There is also control of the market economy whereby the state owns the wealth of the nation while the people are left to have a few. There is also the presidential form of government where the executive and the legislature exist two separate entities. In the USA, the Congress and the presidency are separate even though they both check each others powers (Goldman et al, 2008). The cabinet is made up of members who are not in the congress but their appointment must be approved by the congress. They exist for a set time in office after which elections are held. Likewise in Indonesia, the system is the same in that the president can be impeached by the congress if he does not perform according to the required standards and has the power to veto bills passed by the parliament (Ramage, 1995). This system of government has advantages in that decision making is faster and that there are checks and balances which prevents abuse of power. But in cases where there is change of power there is a stop of polices as different presidents come up with different ways of solving problems for example: In the US, the Bush- Obama trans ition that led to economic policies being changed. Democracy is the other form of government which comes from Greek a word demos which means people and kratos which means rule. It is a form of government that is meant to ensure equal representation of people of all kinds and also that they are free to express their views without fear to create a fair and just society (Goldman et al, 2008). Democracy has a number of problems. In the USA, apathy is a factor that has caused democracy to fail in that since it is a capitalist system only the people with money rule the day. The various interest groups who lobby at congress corridors to stop policies bribing legislators at the expense of the people who elected them in power. Also having money means that one can be elected in parliament as elections are costly and also that the electorate can be bribed to vote in a particular way or for a particular person. Although there is free press, this is an impediment to democracy as the media can favor a particular idea more than the others as long a s the people have money. There is also the problem of immigrants who the US government finds them hard to integrate especially radical Muslims. Democracy entails that there be freedom and equal rights but the Muslim beliefs makes it impossible for them not to be held without suspicion in the country. The terrorism threats, suicide bombings have caused the US who is the mother of democracy to be at war all over the world with terrorists (Goldman et al, 2008). In China, democracy has failed due to a closed system of government that has restricted the flow of information in and out of the country and also the control of media content in that whatever the state does cannot be criticized. China views democracy as a Western ideology hence seeks to à ¢Ã¢â ¬Ã
âprotectà ¢Ã¢â ¬Ã its citizens from that influence. Even though there are elections, only the candidates that the ruling party approves will be elected and this means that the people do not have a say on who will represent them (Li, 2008). In Indonesia democracy has failed because of threats from militias who bring terror and intimidation to the people causing them not to vote. This happened in East Timor, where the militia supporting the ruling party intimidated people to vote in a certain way (Ramage, 1995). There is also foreign interference in elections whereby different world powers want a government that will support their interests. The US will tend to back a moderate pers on who will not tolerate the radical Islamists. In conclusion, I still believe even with all these problems caused by the government that it is necessary for us to have one. Countries in a state of anarchy are chaotic women are raped, children are violated, there are massive killings as people are struggling to be in power because there is no one to maintain order. History has taught us that the people have their destinies in their hands and that they can overthrow a government that does not advocate for their interest and put in place people who can bring the change that they want.

Positive Effects of Conservation Tillage For centuries farmers have used plowing as a tool for weed control, and in some cases to promote plant growth. At first man had used animals to pull plows and other equipment, with the invention of the tractor work that would normally be done with animals could be done more easily and quickly. Although plowing has been a common and widely used tool for managing weed control, there are many negative impacts associated with this method. Conservation tillage is a method where some of crop residues, if not all of crop residues, are left on the surface of the soil. Conservation tillage methods have become popular in many areas around the world, and while many of the effects of conservation tillage are still under research, many farmers have found that it helps to not only protect the health of their fields, but also that it saves both time and money. Research shows that conservation tillage has many beneficial effects such as the reduction of soil compaction, increases in biodiversity, higher crop yields, decreases in erosion, reductions in fuel requirements and other capital inputs for machinery, and up to a seventy percent reduction of preharvest labor. Researchers are not the only ones that are noticing that conservation tillage has a promising future which combines low labor requirements with low erosion rates (Giere, 2002). Amazing Grace Essay -- essays research papers
Jonathan Kozol's Amazing Grace is a book about the trials and tribulations of everyday life for a group of children who live in the poorest congressional district of the United States, the South Bronx. Their lives may seem extraordinary to us, but to them, they are just as normal as everyone else. What is normal? For the children of the South Bronx, living with the pollution, the sickness, the drugs, and the violence is the only way of life many of them have ever known. In this book, the children speak openly and honestly about feeling 'abandoned', 'hidden' or 'forgotten' by our nation, one that is blind to their problems. Studying the people themselves would only get us so far in understanding what their community is really like and why they feel this way. Jonathan Kozol really got to know the people individually. We can take his knowledge and stories to try for a better understanding of the environment in which they live. By doing this, we can explore the many reasons why the people have problems, what some levels of intervention could be, and possibly find some solutions to making the South Bronx a healthier and safer place for these children and others to live. Problem Identification The environment in which we study these people can only be defined by first taking a look at possible reasons why the people have problems. Some of the problems discussed in Amazing Grace have festered throughout the United States for some time now. The high numbers of drug users in the community, the high amounts of gang-related violence, and the numerous cases of people who have contracted the AIDS virus are just some of the problems that have arisen in this ghetto. There are many differences between this community and others in the United States, one of which is that the government has grouped these people all together and made a ghetto of the lowest income families. This has ostracized them from the rest of the nation. It has given them many abandonment issues to deal with, while also telling them they are not worthy of living among the wealthier population. Environmental factors are involved in the problems arising in the South Bronx. Pollution, for example, could be the biggest source of the high number of children in the community who have asthma. Asthma is a condition in which one has trouble breathing. Without clean ... ...s for the people in these neighborhoods have gotten to be that of violence and drugs. These are not healthy norms. To change them, the communities could use more education on social issues in the schools and communities to help the people learn to live healthier lifestyles, to get the word out that violence and disruptance are not all right, and to help the people obtain some community unity. Getting some of the well known community members involved in politics is another way they could get their voices heard and let the government know their needs and desires. Support groups held for people with AIDS, for people who have lost loved ones, and also for people who just need a place to talk about their emotions and get their frustrations out, would help the community as a whole and get more people involved in the healing process of that community. If the people in the South Bronx would act as a community bound together to help themselves and each other, there would be less tolerance for deviant behavior among it's members. Then the ones who act defiantly could be out-numbered, and the good citizens of the South Bronx could reclaim their homes and their lives.

ââ¬ËLord of the Fliesââ¬â¢ by William Golding describes a group of schoolboysââ¬â¢ means of life when they become stranded on a desert island after a plane crash which killed all other passengers and crew, with only vast jungle and sandy shores around them. During their unusual experience, one of the main characters ââ¬â Ralph ââ¬â learns thing about himself and the others that no other twelve year old would ever imagine. With ââ¬Å"a mildness about his mouth and eyes that proclaimed no evilâ⬠, Ralph seems the laid-back sort, confident and trustworthy. Although when he first meets Piggy, another schoolboy, this all changes and the immaturity of a typical child of his age shines through. When finding out that his new friend used to be nicknamed ââ¬ËPiggyââ¬â¢ as a result of his short and fat appearance, ââ¬Å"he dived in the sand at Piggyââ¬â¢s feet and lay there laughing.â⬠Ralph thinks of Piggy as a paranoid wimp, and relishes in the fact that they have a whole island to roam around on, with no grown-ups to tell them what to do. Piggy, however, instantly realises the severity of what has happened, and panics at the thought of the future: ââ¬Å"We may stay here till we die.â⬠As far Ralph is concerned, the island is paradise. He is glad when he meets Jack, another one of the bunch of schoolboys with an obsession for hunting, but who is out to have fun on the island. Things get off to a good start, but when their new way of life descends into disaster, Ralphââ¬â¢s relationship with Piggy grows as it comes clear that Piggy is actually a very wise person, and Ralphââ¬â¢s relationship with Jack turns to rivalry, Ralph finds himself having to grow up quickly and reinforce his position as leader to restore civilisation ââ¬â a fast fading luxury: ââ¬Å"We need an assembly. Not for funâ⬠¦..but to put things straight.â⬠When Jack becomes fed up with Ralphââ¬â¢s rules and leadership tactics, he decides to break away from the crowd and forms his own tribe of ââ¬Ëhunters.ââ¬â¢ By this point Ralph grows aware that trying to persuade them to stay with his tribe, he is fighting a losing battle, and discovers that he may not be as good a leader as he thought he would be: ââ¬Å"Only, decided Ralph as he faced the chiefââ¬â¢s seat, I canââ¬â¢t think. Not like Piggy.â⬠The death of Simon, a quiet, subdued fellow schoolboy, really disturbs Ralph, as he faces up to reality. Simonââ¬â¢s death was a consequence of Jackââ¬â¢s tribe getting overexcited about ââ¬Å"the beastâ⬠and was a mistaken identity case involving the beach, many spears, and a chorus of youngsters wildly chanting ââ¬Å"Kill the beast! Cut his throat! Spill his blood! Do him in!â⬠The realisation of the awfulness that occurred affects all of the boys not in Jackââ¬â¢s tribe, and in a moment of sheer alarm, Ralph almost snaps: ââ¬Å"That was murder.â⬠Piggy, now the most faithful and loyal friend Ralph has left on the island, canââ¬â¢t bear to even think about it, let alone discuss it: ââ¬Å"You stop it! What goodââ¬â¢re you doing walking like that?â⬠By this time, the relationship between Ralph and Jack has deteriorated so much that bitterness from power-possessed Jack is all that is left. By the end of the novel, it is clear that the relationship between Ralph and Jack has no amiability in it whatsoever. The power and authority that Jack enforces over his tribe portrays him as a king to the reader: ââ¬Å"Power lay in the brown swell of his forearms; authority sat on his shoulders and chatted in his ear like an ape.â⬠After Simonââ¬â¢s untimely death, Jack and his tribe seem somewhat unaffected by what they have done, and become even more uncivilised, to the extent that they cause another shocking and unexpected death. Piggy is killed by a rock that Roger pushes over the edge of the cliff, near the beach. This event shows just how disconnected with reality Jack and his tribe have become, and now Ralph is on his own. His only friendââ¬â¢s death has made him now completely alone and so vulnerable. Ralph feels like he is the only one left with any sense of the real world. The shock of what has happened since they first explored the island scares Ralph and fear of the future kicks in. ââ¬Å"These painted savages would go further and further. Then there was that indefinable connection between himself and Jack; who therefore would never let him alone; never.â⬠Jack discovers that Jack and his tribe are planning to kill him the next day, and now survival is the only thing that matters to Ralph. Realisation of his desperate situation comes to Ralph when he is told by one of the twins ââ¬Å"Listen, Ralph. Never mind whatââ¬â¢s sense. Thatââ¬â¢s gone.â⬠A lonely, terrified, weak and exhausted Ralph wakes the next day to noises of every other child on the island hunting him down. They set fire to the island and eventually locate Ralph, and then the chase begins. Ralph reaches the end of island, and the end of his sanity. He literally runs into a naval officer and recognition of everything hits the twelve year old. Shock of the circumstances is all too much for Ralph to bear, and he falls to his knees and breaks down. ââ¬Å"Ralph wept for the end of innocence, the darkness of a manââ¬â¢s heart, and the fall through the air of the true, wise friend called Piggy.â⬠Ralph takes responsibility for the chaos and collapse of civilisation, as he believes that if he had been a better leader, none of this would have happened. He realises just how far things can go when there is no order imposed, and that he alone couldnââ¬â¢t change that. Throughout the novel, Ralph makes a journey towards self-discovery, and witnesses behaviour no other person, like the naval officer, would believe if he explained them. His relationships with the other two main characters influence the horrific events that took place on the island, and at the end of ââ¬ËLord of the Fliesââ¬â¢ Ralph sees that man can lose all sense of civilisation when no rules and order are in place.

Global Warming and Its Management Essay
Managers are the most important human resource in any organization because they are charged with the responsibility of ensuring that the organizational goals are achieved within the specific time through a good business environment. Both organizations and people need each other to further their different goals or objectives. Therefore if mutuality is missing, it makes no sense in trying to assemble a group and develop a cooperation because there is no common base on which to build. Therefore, for attainment of organizational effectiveness, human resource and especially the managers is the most important asset that must be paid attention by the management. (Rampton, 2003) Causes of global climate change From this article we find that Dr Walker suggest that global climate change is not necessarily caused by the increased use of the fossil fuel, many scientists have been found to be against his arguments claiming that most of the global warming cases are caused by human activities apart from that caused by climatic changes, whereby we find that they reported that in the year 1998 the earth was found to be warmest as compared to the current years arguing that the carbon dioxide concentration is higher claiming that it has increased by over three percent, these scientists claim that a rise in the global warming is mainly caused by the following factors There have been heated political, religious, social and scientific arguments about what could be the causes of global warming. Scientifically, burning of fossil fuels such as petrol, coal, electricity, garbage disposal, and methane from reared animalsââ¬â¢ e. g. dairy cattle, goats and sheep the atmosphere of the earth is everywhere and it includes the air we breathe. The earthââ¬â¢s surface, water, land, and the whole biosphere absorb the heat from the sun after which it sends it back to the atmosphere. However, some of the sunlight energy passes back to the space while a good percentage is trapped by the greenhouse gases in the atmosphere thus causing the earth to heat up. (Maslin, 2004) From the article we find that Dr Walker says that most of the green house gas effects are brought up by the existing water vapor and the carbon dioxide resulting from the human activities he is reported saying that ââ¬Å"the anthropogenic carbon dioxide increase in the atmosphere makes an insignificant contribution to the enhanced greenhouse gas effectââ¬â¢ research indicates that many scientists are against the Doctors ideas are incorrect they bring in the idea that in the cases where there is an increase in the concentration of the carbon dioxide with the combination of the other green house gases will actually lead to an increase to the amount of vapour in the atmosphere and since scientifically vapour is found to be a strong green house gas cause an increase in the atmospheric temperature which is regarded as a positive effect to the atmospheric change. This vapour also leads to the formation of cloudiness which brings in cooling effect to the atmospheric temperate which many scientists regard it as a negative effect. Managers in many organizations in an effort to be effective and efficient in the understanding of global warming effects have the planning responsibility of balancing the ever competing demands of their roles brought about by effects of changing climate in the world. In order to attain the above objective this managers have embarked on planning and controlling roles in order to avoid any unwanted outcome as a result of changing climate and thus achieve the desired output. Such roles include the following Managers in most organizations through the overall controlling function act as change agents within these organizations. There is increased interaction of people from different cultures, societies, and various backgrounds in undertaking various business activities with the aim of achieving their goals for example opening of more branches that has effects on the business environment . e. g through pollution. Because of invention of advanced technology the world has increasingly become a village and as a result global business is the modern form of business in this 21st century. Therefore managers are expected to strategize on the best controlling measures of changing climate in order to change the business activities to the desired levels that do not further effects of global warming. (Rampton, 2003) Because of globalization in relation to business firms there have been great disregard to national borders, governments have lower hand in controlling the flow of their economies and large companies including organizations are now not restricted to only one particular country as it was before. Managers in these organizations through the planning function have to cope with changes brought about by this aspect of globalization particularly on the issues relating to garbage and sewerage treatment. This implies that mangers have to incorporate the desired actions in the planning process in order to curb the changing climate that may affect the success of businesses in the future. They also have the task of ensuring that the employees in the organizations are well equipped with skills, expertise, and knowledge that can help understand the effects of global warming. Middle managers have the planning duty of being a strategist in order to cope with the increasing demands particularly with regards to the effects of global warming on success of an organization. This implies that they have the tasks of ensuring that the strategies formulated by the organization are implemented and executed in a good way that will lead to decreasing the effects of global warming. They should therefore have the ability to interpret direction from the external bodies like the United Nations in to functional departmental strategies and policies that will avoid any conflicts in the organization and those plans must be viable and supportive for the mission of the organization regarding changing in climate. (Maundy, 2001) In order to enhance this responsibilityââ¬â¢ the managers must pay much attention to formulation of workable strategies. A strategy may be defined as the calculated means by which the enterprise deploys its resources to accomplish its purpose and basic objectives under the most advantageous circumstances. Therefore the mangers have the task of ensuring that the organization for example a multinational firm must be overall low cost effective system which will ensure good systems of controlling pollution, sewerage and garbage treatment among other climate effects by using of advanced technologies. So the work of middle managers is to ensure sourcing of competent expertise and application of approved high quality technologies e. g. the use of approved chemicals in treating of sewerages. This implies that planning and controlling functions will be required by managers in order to enhance formulation of viable strategies as well as setting parameters on how such strategies are controlled. Managers must also act at as ethicists in any organization in order to balance the competing demands brought about by the effects of global warming. This role implies that the managers should develop a system that will help them sustain pressure from external forces in the process of promoting positive effects of global warming. This implies managers must show commitment, support and cooperation among the top management, low level management or the subordinates and themselves regarding the controlling of effects of climate changes. For these managers to maximize the concept of teamwork in the organization then they should emphasize on formation of groups within the workplace. A group can be defined as social unit which people interacts face to face when working. If an organization emphasizes group work then it is more likely that good results will be achieved. Sometimes some kind of work require teamwork participation in order to achieve goals, so managers should encourage group decisions too because they bound to succeed unlike individual decisions. This may involve planning function of coming up with ideas regarding making decisions jointly concerning how to curb the effects of global warming. (Maundy, 2001) Economic Effects The economic implications of global climate change are worse since these weather phenomenons occur unpredictably. Insurance companies for example have a lot to loose when a weather condition such as the El Nino damage property and businesses which makes it not only difficult to compensate but also expensive to cater for. Economic implications are considered to be harsh for third world countries as compared to developed countries because they lack the capacity to counter such disasters of big magnitudes. The other sector of the economy affected by global warming is the transport sector. Most of the infrastructure in Indonesia and India has collapsed as an outcome of these disasters thus making it very expensive for the countries to repair and maintain them. Agricultural production being dependant on weather conditions of a particular place is under threat from global warming. Countries in the Islands such as Madagascar produce very little agricultural produce not because they lack the water but because the conditions there are very uncertain and also harsh such that only greenhouses can produce well.

Sources of English Law By Christopher Richards 9/11/09 Executive Summary In this report I will be discussing the English Legal System, its structure and its primary sources. English law and its legal structure forms the basis of many countries common law legal system, this includes most commonwealth countries and the United States. English law falls into two broad categories: Civil law ââ¬â derived from Roman law, it is applied when ââ¬Å"wrongsâ⬠have been made against individuals; it is also know as a claim or an action. Criminal law ââ¬â first instrumented following the Norman Conquest of 1066, Its offences relate to ââ¬Å"wrongsâ⬠against property and, or persons which affects the whole community, it is often referred to as prosecution.. I will explain why the methods and tools of statutory interpretation are necessary for the correct implement of statutes and how judicial president formed the backbone of English common law. Introduction The English legal system stems from The Norman Conquest, William of Normandy invaded England in 1066 and upon successfully defeating his adversary he gained the crown of England. William formed the fist basic government ââ¬Å"The Kingââ¬â¢s Councilââ¬Å"(Magnum Concilium) comprised of Lords, Bishops, Barons and other trusted figures Whoââ¬â¢s advice which the monarch relied on. Introduced the separation of lay courts and church courts with a binding jurisdiction leading to church law i. e. : clergy were tried in there own courts. As the Monarch William owned all of England with lords, bishops and barons possessing land as tenants or sub tenants, this prompt the introduction of Feudalism of land tenure and judicial activity. Common lawâ⬠would be established by Judges discussing conduct and behaviour throughout the land, still at this point no legislation was ever written down. Further changes arise, these includes the advancement of ââ¬Å"Case lawâ⬠setting precedent through facts of similar cases that have already been decided so that it can be judged equally, additionally the hierarchy of binding precedents and court structure. Statutory Interpretation Some statutes have a vague or misleading words or phrases many with homonyms which can make the process of implementing the correct ruling a difficult one, A few areas to look at are a Broad term (words that are used to cover many possibilities), Ambiguity (were the word has two or more meanings and its not defining in which one should be used), a drafting error (an error that was made when drafting the bill or when it was amended), new developments (developments in technology means that old acts may not cover present day situations) and use of language( words that have changed in meaning over time), this is why statutory interpretation as a tool is so important, it allows judges to look at statutes and deduce the true reasoning behind it, there are three methods which are used to do this. Literal Rule This is the most commonly used construction and takes precedent over the following rules; it means to take words written into the statute literally in the sense that if the words are clear then they should be applied. The literal rules had been scrutinised by many lawyers, and said to be ââ¬Å"a rule against using intelligence in understanding language. Anyone who in ordinary life interpreted words literally, being indifferent to what the speaker or writer meant would be regarded as a pedant, a mischief-maker or an idiotâ⬠. An example of this is in the Hotel Proprietors act 1956, it provides that the hotel proprietor is liable for loss of or damage to guestsââ¬â¢ property, but does not extend to guest vehicles or property left ââ¬Å"thereinâ⬠, so does the proprietor fall liable to property left on, rather than inside the vehicle ? Interpreted literally yes, the proprietor is liable, because if the act had intended to exclude property left on a vehicle the act would have said ââ¬Å"therein or thereonâ⬠so great care must be applied when using this rule. The Golden Rule The golden rule is very much a modification to the literal rule, whereas instead of taking the literal meaning the courts will use a narrow or a wide approach of interpreting the word to avoid an absurd result. If the Narrow approach is applied it would usually be because the word themselves lead to an absurd result for example if there is a sign that say ââ¬Å"do not use lifts in case of a fireâ⬠interpreted literally it would mean ââ¬Å"to never use lifts, in case of a fireâ⬠which would lead to an absurd result but clearly it is to prevent people from using the lifts if there is a fire nearby. The Mischief rule This third rule gives a judge more discretion than either the literal or the golden rule. This rule requires the court to look to what the law was before the statute was passed in order to discover what gap or mischief the statute was intended to cover. The court is then required to interpret the statute in such a way to ensure that the gap is covered. The rule is shown in Heydon's Case (1584), where it was said that for the true interpretation of a statute, four things have to be considered: 1. What was the common law before the making of the Act. 2. What was the mischief and defect for which the common law did not provide. 3. What remedy Parliament hath resolved and appointed to cure the disease of the Commonwealth. 4. The true reason of the remedy, and then the office of the Judges is to make such construction as shall suppress the mischief and advance the remedy. An example of the mischief rule in use is found in the case of Corkery v Carpenter (1951). In 1951 Shane Corkery was sentenced to one month's imprisonment for being drunk in charge of a bicycle in public. The defendant was drunk and was pushing his pedal bicycle along Broad Street in Ilfracombe. He was charged under section 12 of the Licensing Act 1872 with being drunk in charge of a carriage. The 1872 Act made no reference to bicycles. The court elected to use the mischief rule to decide the matter. The purpose of the Act was to prevent people from using any form of transport on a public highway whilst in a state of intoxication. The bicycle was a form of transport and therefore the user was correctly charged. Purposive approach This rule exceeds the mischief rule by not just looking for gaps in statutes but for judges to decide what parliament actually meant to achieve. One of the true supporters of this rule is Lord Denning, his attitude towards this rule is shown in the case of Magor and St Mellons v Newport Corporation (1950) ââ¬Å"We sit here to find out the intention of parliament and carry it out, and we do this better by filling in the gaps and making sense of the enactment than by opening it up to destructive analysisâ⬠This approach does have its drawbacks and many a judge has voiced its shortcomings saying that, should judges refuse to follow the clear words of parliament and how do they know what parliamentââ¬â¢s intentions were? Summary Statutory interpretation as tool is paramount, without it, statutes that were written 100 years ago just wouldnââ¬â¢t be able to be implemented unless statutory interpretation was used. It allows judges and Lords the flexibility to look into statutes and decide whether it is still fair to implement, to break down statues and to interpret how they were original intended, additional if bills hav e been written incorrectly the judge can use statutory interpretation to avoid absurd results and not make a mockery of the English Legal System. Rules of Language Eiusdum generis (of the same kind) In addition to the rules above, the courts also rely on rules of language to assist in statutory interpretation. The general words are to be taken as referring only to those things of the same class as specifically mentioned e. g. ââ¬Ëcats and dogsââ¬â¢ does not include wild animals. There must be at least two specific words in a list before the general word or phrase for this rule to operate. (the phrase ââ¬Ëtheatre or other place of public entertainmentââ¬â¢ includes a funfair even though it was not of the same kind as theatres). Expressio unius est exclusio alterius (the mention of one thing excludes others) This is when one or more things of a particular class are mentioned but others may be silently excluded this can be seen in the case of Tempest v Kilner (1846) the court had to decide whether stock and shares were affected by the statutes of fraud 1677(which states that the contract of goods, wares and merchandise of the value of ? 10 or more must be evidenced in writing) but it was deemed that list of goods, ware and merchandise was not followed by general words(stocks and shares) and were not affected by the statute. Noscitur a sociis (a word is known by the company it keeps) This rule of language used by the courts helps interpret legislation, under which the questionable meaning of a doubtful word can be derived from it association with other words. This can be seen in the case Foster v Diphwys Casson (1887), this involved a statute which stated that explosives taken into a mine must be in a ââ¬Å"case or canisterâ⬠. Here the defendant used a cloth bag. The courts had to consider whether a cloth bag was within the definition. Under noscitur a socials, it was held that the bag could not have been within the statutory definition, because parliament's intention was referring to a case or container of the same strength as a canister. Intrinsic Aids are things inside the act which assist the judge to interpret or apply the law. Extrinsic Aids are things outside the act which assist the judges to apply or interpret he law. For example the judges can look at previous acts of Parliament and the historical setting. Judicial precedent A judicial precedent is a decision of the court used as a source for future decision making. This is known as stare decisis (stand upon decisions) and by which precedents are binding and must be followed. When new cases are brought to court for the first instance and there are no previous cases to base the judgement, this is called Original president. Binding precedent is where past judgements of a similar set of facts are implemented to help courts to keep cases fair by deciding the outcome based upon previous cases. The common law has been developed by passing down from precedent to precedent. In giving judgement a judge will state the law, set out the facts and then provide a decision , it is only the ratio decidendi (the legal reasoning for judicial decision)which is binding in later courts. Orbiter dicta (other things said) may be put forward in future cases but it is not binding, the difficulty is the separation of the two from past judgement as they are not usually listed separately. Judicial precedent is an important source of English law as an original precedent is one which creates and applies a new rule. However, the later decisions, especially of the higher courts, can have a number of effects upon precedents. In particular, they may be: â⬠¢ Reversed: where on appeal in the same case the decision is reversed, the initial decision will not continue to have any effect â⬠¢ Overruled: In a later case a higher court decides that the outcome of the first case was wrong. â⬠¢ Distinguished: where an earlier case is rejected, either because the material facts differ or because the statement of law in the previous case is too narrow to be properly applied to the new set of facts â⬠¢ â⬠¢ A refusal to follow: this arises where a court, not bound by the decision, cannot overrule it but does not wish to follow it so it simply refuses to follow the earlier decision â⬠¢ Explained: a judge may seek to interpret an earlier decision before applying it, so the effect of the earlier case is varied in the circumstances of the present case. Court hierarchy and structure In England and Wales there is a strict hierarchy of the court system, every court is bound by a decision made by a superior court in its hierarchy and appellate courts (courts that hear appeals) are generally bound by its own decision. Courts of first instance Is where the original case was heard, The ECJ, House of Lords, court of appeal and divisional courts do not hear any original cases as they only hear cases of appeal. Therefore, it is necessary to expand the appeals of Hong Kong. Why not use our existing natural resources as tourist attractions? To maintain the competitiveness, Hong Kong should build up its own unique and special character. Natural wonders of the territory provide a chance to show the uniqueness and international significance of Hong Kong ecology.Green tourism, outdoors, hiking and nature are some of the new and promising products most needed by consumers. Building ecotourism could attract special interest tourists. It was found that nature-based activities or scenery is one of the top attractions which the visitors to Hong Kong are interested in. Migration is a strong instinct, and birds (particularly water birds) are often able to traverse immense natural barriers, frequently migrating and maki ng one or more stopovers en route.In Hong Kong, we can watch butterflies in all seasons due to warm climate and the presence of a variety of habitats. There are over 230 butterfly species in Hong Kong and more than 130 species have been recorded in Hong Kong Wetland Park. The Butterfly Garden in the Hong Kong Wetland Park is planted with various larval food plants and nectar plants. It is an ideal place for learning butterflies. Dragonflies and damselflies are among the most beautiful and spectacular insects in the world.Their lives are closely intertwined with wetlands. Up to April 2009, there are 115 species of dragonfly officially recorded in Hong Kong. During the Dragonfly Festival, Hong Kong Wetland Park will organize a series of activities for public to broaden their knowledge of dragonflies. These activities also aimed to promote dragonflies watching and encourage the public to engage in the conservation works of wetlands and dragonflies. Our bustling metropolis has more than 40% of its land designated as protected green areas.Apart from providing habitats for our myriad wildlife, this verdant countryside is also home to world-class rock formations and geological features. A geopark is a unique natural area with special geological significance and natural and cultural landscapes, and can serve the three objectives of conservation, education and sustained development. The Marine Parks Ordinance protects and conserves the marine environment and a rich collection of aquatic animals and plants, such as corals, sea grasses and dolphins.
